Do Indianapolis apartments have to fix mold?

Short answer

Generally, yes, when the mold comes from a building problem. Indiana landlords, Indianapolis apartment owners included, have legal duties to maintain rental housing, and city codes add property maintenance rules. How quickly a repair has to happen, and what tenants can do if it doesn't, vary with the facts. Why apartment mold is its own problem

Mold in an apartment rarely stays a one-unit problem. Units share walls, plumbing stacks, roofs and sometimes air handling, so the water that causes mold often starts somewhere the tenant can’t see or control. The patterns we run into in Indianapolis complexes:

  • A leak from the unit above, through a tub, toilet, washer or water heater, that soaks the ceiling and wall cavity below.
  • HVAC closets, where condensate lines clog and drip, or the air handler pulls in damp air.
  • Ground-floor and garden-level units that sit partly below grade against cool, damp walls.
  • Window condensation in older buildings with single-pane or failing windows during Indiana winters.
  • Bathrooms with weak or broken exhaust fans, which the tenant can’t fix.

What the landlord’s duty generally covers

Indiana law places duties on residential landlords to keep rental property safe and habitable and to keep essential systems such as plumbing and heating working. The City of Indianapolis also enforces property maintenance standards through its code enforcement staff. Mold isn’t always named directly in those rules. It usually comes in through the water behind it: a leaking roof, broken plumbing, or ventilation that doesn’t work. When a building problem causes mold, the repair generally falls to the owner. How to report it so it gets fixed

Most large complexes use an online maintenance portal. Use it, but don’t rely on it alone. Portal tickets can be closed without the work getting done, and they’re hard to retrieve later. Put the request in writing in the way your lease requires, keep a copy, and include where the mold is, roughly how large an area, any leak you know about, and the date you first noticed it. What a real fix looks like

A maintenance tech wiping the wall with bleach and painting over it is a common first response. It isn’t a fix. A proper repair finds and stops the water first, then removes or cleans the affected material with the area contained so dust doesn’t spread into the rest of the unit or the hallway. In a multi-unit building, a good repair also checks next door and below, since the leak that reached your ceiling may have wet the wall cavity next to it. If the landlord doesn’t act

  • City code enforcement. In Indianapolis, the Mayor’s Action Center takes property maintenance complaints and routes them to the city’s code enforcement staff, who may inspect the unit.
  • Indiana Legal Services. Nonprofit legal aid for eligible tenants with housing problems.
  • A tenant attorney. For advice on your lease, your options and what notice is required.
  • An independent inspection. A written lab report turns “it smells musty” into facts that code inspectors and attorneys can act on.
